These terms govern your use of retainhealth.co. They do not govern a search engagement — that relationship is set out in a separate written agreement signed by both parties. Where these terms and a signed engagement agreement conflict, the engagement agreement controls.
By using this website, you agree to these terms. If you don't agree, please don't use the site.
This site describes our services, publishes our fee structure and methodology, and provides tools including a seat-cost calculator. It is informational.
The calculator produces estimates, not advice. It uses assumptions you set, drawn from published sources, and it does not account for the specifics of your organization. It is not financial, accounting, legal, or hiring advice, and it is not a valuation. Do not rely on it as the sole basis for a decision.
Nothing on this site is an offer to enter into an engagement, a guarantee of a placement, or a promise of employment to any candidate.
The fees published on this site are our standard rates and are calculated on a placed candidate's first-year base salary only. Bonus, sign-on, equity, relocation, and variable compensation are excluded unless agreed otherwise in writing.
Replacement guarantees are described on the site in summary form. The terms that apply to any specific search — including the guarantee window, what voids it, and how a replacement search is run — are set out in the signed engagement agreement for that search.
We reserve the right to change published fees at any time. A change does not affect a search already under a signed agreement.
The Retention Index™ is our proprietary assessment methodology. It is advisory: it informs whether we introduce a candidate for a specific role. It does not make hiring decisions, and it is not a validated predictive instrument. Every score is assigned by a person, and every hiring decision is made by the employer.
The methodology, the Retention Index™ name, and the content of this site are our intellectual property. You may read, print, and share our published materials for your own internal use. You may not republish, resell, or use them to build a competing service.
This site links to third-party services, including AI assistants, our email platform, and Blue Pen Resumes. We don't control those services and aren't responsible for their content, availability, or privacy practices. Your use of them is governed by their terms.
The site is provided "as is." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and accuracy of content. We do not warrant that the site will be uninterrupted or error-free.
To the fullest extent permitted by law, our total liability arising out of your use of this website is limited to the greater of the amount you have paid us for services giving rise to the claim, or one hundred dollars ($100). This limit does not apply to a signed engagement agreement, which contains its own terms.
These terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from your use of this website will be brought in the state or federal courts located in the State of California.
We may update these terms. The version posted here, with its effective date, is the one that applies.
